Terms of Use

1. Acceptance of Terms

By accessing or using kinkstr.app (hereafter referred to as “the App”), you agree to comply with and be bound by these Terms of Use. If you do not agree to these terms, you may not access or use the App.

2. Eligibility

You must be at least 18 years of age to use the App. By using the App, you confirm that you meet this age requirement. All content posted on kinkstr.app must feature individuals who are 18 years of age or older.

3. Account Registration

To use certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary.

4. User Conduct

You agree not to use the App for any unlawful purpose or in any way that could damage, disable, overburden, or impair the App. Prohibited activities include but are not limited to:

  • Engaging in any form of harassment, abuse, or harmful conduct toward others.
  • Posting content that is obscene, defamatory, or otherwise offensive.
  • Impersonating any person or entity or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
  • Sharing or posting any content that infringes upon the intellectual property rights of others.
  • Engaging in any activity that violates the privacy of others, including the sharing of private information without consent.

5. User Content

You are responsible for any content you upload, post, or otherwise make available through the App. By submitting content, you grant kinkstr.app a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform the content in connection with the App.

Content Age Requirement:

All content posted on kinkstr.app must feature individuals who are 18 years of age or older. Any content that includes minors or individuals under the age of 18 is strictly prohibited and will result in immediate account suspension or termination.

6. Prohibited Content

The following types of content are strictly prohibited on kinkstr.app:

  • Hardcore Adult Content: Content that depicts explicit sexual acts or extreme sexual fetishes.
  • Racism and Antisemitism: Any content that promotes or incites hatred, discrimination, or violence based on race, ethnicity, or religion.
  • Violence and Weapon Usage: Content that glorifies, incites, or depicts violence or the use of weapons.
  • Political Content: Content that promotes or discusses political ideologies, parties, or events.
  • Race Play: Content that involves racial or ethnic humiliation, degradation, or fetishization.
  • Full Frontal Nudity: Content that includes full frontal nudity without the inclusion of gear or kinks is not permitted.

7. Types of Accounts and Content Guidelines

Personal Accounts:

Personal accounts are designed for individual users to engage with the kinkstr.app community. These accounts are primarily for sharing personal experiences, opinions, and interactions.

Business, Non-Profit, and Advocacy Group Accounts:

  • Business Profiles: These accounts are for companies or commercial entities using kinkstr.app for promotional purposes. Content related to services, products, or business initiatives should only be posted on business profiles.
  • Non-Profit and Advocacy Group Profiles: These accounts are designed for organizations focused on charitable causes, social justice, or other advocacy efforts. All content related to these organizations must be posted on business profiles and not personal accounts.

Commercial Use Policy:

Any use of kinkstr.app for commercial purposes requires a Professional/Business plan or higher. If you use a personal account for commercial purposes while subscribed to a lower-tier plan, kinkstr.app reserves the right to suspend or terminate your account without prior notice.

8. Content Sensitivity

We recommend that users avoid bringing up topics related to gender, sexual orientation, species, body type, body shaming, or any other subjects that could potentially trigger or offend others. Maintaining a respectful and thoughtful approach to content helps foster a welcoming and inclusive community.

9. Moderation Policy

At kinkstr.app, we are committed to maintaining a safe and respectful environment. To achieve this, we have a comprehensive moderation system:

Staff Moderation:

We employ a dedicated team of moderators who review the content submitted to the moderation queue, ensuring compliance with our guidelines.

Self-Moderation and Community Reporting:

kinkstr.app operates on a self-moderation policy, encouraging users to report content that offends, triggers, or violates our Terms of Use. By reporting inappropriate content, users help ensure that the community remains respectful and inclusive.

Blocking and Reporting:

Members have the ability to block other members. If a member is blocked by 5 different users or reported by 5 different users, it will result in automatic account suspension pending review by the moderation team.

10. Server Locations and Local Laws

kinkstr.app operates servers located in New York City, United States, and Amsterdam, Netherlands. By using the platform, you agree that we are bound by the local laws where our infrastructure is located. All content and data on our servers are subject to the legal jurisdictions of these regions.

11. Lawful Intercept and Content Disclosure

In the event that we receive a lawful subpoena or request from law enforcement, we may be required to provide access to user content. However, we will only release content if it has been reviewed and deemed unlawful under applicable laws.

12. Indemnification and Waiver of Arbitration

By using kinkstr.app, you agree to indemnify and hold harmless kinkstr.app, its parent company CreateSpace Media Group, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the App, your violation of these Terms of Use, or any illegal activities conducted through the platform.

Waiver of Arbitration:

By agreeing to these Terms of Use, you expressly waive your right to arbitration for any disputes, controversies, or claims arising out of or related to kinkstr.app or CreateSpace Media Group, including its employees, officers, and directors. Disputes will be resolved exclusively in a court of competent jurisdiction.

13. Account Inactivity

For users with free accounts, if your account remains inactive for a period of three months (90 days), kinkstr.app reserves the right to delete your account and associated data. Inactivity is defined as not logging into the account or interacting with the platform for the specified period. Recovery of deleted accounts is not possible.

14. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of United States, without regard to its conflict of law principles.
